IMPORTANT — READ CAREFULLY

These Terms of Service (“TOS”) establish a legally binding agreement between you (“Customer,” “Guest,” “Member,” or “User”) and LaserShots, LLC (“LaserShots,” “we,” “us,” or “our”) governing your use of our website, purchase of firearms, optics, accessories, and training gear, and participation in virtual shooting simulator facilities, memberships, or instruction (collectively, “Services”).

BY PURCHASING PRODUCTS, VISITING OUR STORE, SIGNING UP FOR A MEMBERSHIP, OR USING OUR VIRTUAL SIMULATORS, YOU AGREE TO BE BOUND BY THIS TOS. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES OR FACILITIES.

Note: Section 15 contains a binding arbitration clause and class action waiver that affects your legal rights regarding all disputes.

1. Nature of Business & Third-Party Software

  • Business Scope: LaserShots, LLC is a licensed Federal Firearms Licensee (FFL) operating a physical retail storefront, e-commerce platform, and virtual marksmanship/shooting simulator facility.

  • Third-Party Software & EULAs: LaserShots, LLC resells, integrates, and utilizes virtual shooting software, recoil training platforms, and digital marksmanship media developed by independent third-party manufacturers. All software product licenses are provided subject to the respective manufacturer’s End User License Agreement (EULA). LaserShots, LLC does not own, develop, or grant licenses to third-party software, and your use of such software is strictly governed by the producer’s terms.

2. Virtual Simulator Rules & In-Store Liability Waiver

  • Separate Liability Waiver Required: In order to access or utilize our virtual shooting simulators, all participants (or their parent/legal guardian) must execute a separate, standalone In-Store Liability Waiver and Release Form prior to entering the simulator area.

  • Minors: Minors must have a parent or legal guardian execute the liability waiver on their behalf and must be accompanied by an adult at all times while utilizing the facility.

  • Safety & Conduct: All participants must strictly adhere to posted facility rules, range safety guidelines, and staff directions. Live ammunition is strictly prohibited in designated virtual simulator areas.

  • Right to Refuse Service: LaserShots, LLC reserves the right to deny simulator access, terminate a session without refund, or remove any individual from the premises who demonstrates unsafe behavior, appears intoxicated, or fails to comply with safety protocols or waiver requirements.

3. Firearm Sales, ATF Compliance & Background Checks

  • Federal, State, and Local Laws: All firearm and regulated accessory transactions are subject to strict compliance with the Gun Control Act (GCA), National Firearms Act (NFA), ATF regulations, and applicable state/local laws.

  • Background Checks: All firearm transfers occurring on-premises require a completed ATF Form 4473 and approval via the National Instant Criminal Background Check System (NICS) or state equivalent.

  • Denials & Transfers: If a background check is denied or delayed, or if a buyer is legally disqualified from taking possession of a firearm, the buyer is responsible for any applicable restocking, processing, or return fees. Customers are responsible for verifying the legality of products in their local jurisdiction before purchasing.

4. Retail Sales, Shipping & Returns

  • Orders: All retail purchases are subject to product availability and price verification.

  • Restricted Items: Certain items (e.g., high-capacity magazines, suppressors, specialized tactical gear) are subject to shipping restrictions based on federal, state, or local laws. We do not ship restricted items to prohibited jurisdictions. See our full Shipping Policy for details.

  • Returns: Firearm sales, special orders, and digital products/software activations are final once transferred or fulfilled. Non-defective accessory returns are subject to our Return & Cancellation Policy and applicable restocking fees.

5. Membership Terms & Standalone Membership Agreement

Independent Membership Agreement: Membership enrollment is governed by this TOS and an independent, standalone Membership Agreement executed upon sign-up. The Membership Agreement details specific plan tiers, facility access rules, guest privileges, and policies regarding minors.

12-Month Minimum Commitment: All recurring membership plans require an initial twelve (12) month continuous commitment (“Initial Term”). By enrolling in a membership, you authorize LaserShots, LLC to charge your stored payment method on a recurring monthly basis for the duration of the Initial Term.

Early Termination Fee: If you cancel or terminate your membership prior to the completion of the 12-month Initial Term, you shall be assessed an Early Termination Fee equal to the lesser of: (i) the total remaining monthly dues left in your Initial Term, or (ii) $250.00. This fee is a mandatory contractual remedy, not a penalty, and will be charged to the primary payment method associated with your account upon processing of the cancellation.

Exemptions from Early Termination Fee: The Early Termination Fee shall be waived strictly upon written notice and receipt of valid supporting documentation for any of the following objective exceptions:

  • Military Relocation: Active-duty military service members who receive Permanent Change of Station (PCS) orders or deployment orders requiring relocation outside the local area.

  • Medical Hardship: Members who experience a permanent or long-term medical condition or physical disability, verified in writing by a licensed physician, that permanently prevents utilization of the facility.

  • Non-Military Relocation: Members who permanently relocate their primary residence more than thirty (30) miles away from the LaserShots, LLC facility, verified by a utility bill, lease agreement, or change of address documentation.

  • Financial Hardship / Involuntary Job Loss: Members who experience involuntary employment termination, verified by a separation notice or official state unemployment documentation.

  • Facility Closure or Relocation: In the event LaserShots, LLC permanently ceases facility operations or relocates its facility more than fifteen (15) miles from its current location.

Renewal & Cancellation: Following the completion of the 12-month Initial Term, memberships automatically transition to a month-to-month agreement. You may cancel your month-to-month membership after the Initial Term by providing thirty (30) days written notice prior to your next billing cycle.

6. Manufacturer Warranties

LaserShots, LLC is an authorized reseller for third-party hardware, optics, accessories, and training technologies. All hardware, software, and equipment carry only the applicable warranties provided by the original manufacturer. LaserShots, LLC makes no independent warranties on third-party products.

7. User Accounts & E-Commerce Security

If you create an account on lasershots.com, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to provide accurate, current information for all orders, memberships, and firearm transfer documentation.

8. Intellectual Property

All logos, branding, original store media, text, and visual content produced by LaserShots, LLC are protected by trademark and copyright laws. Logos, trade names, and media corresponding to third-party software, simulators, or hardware manufacturers are the property of their respective owners.

9. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL SERVICES, SIMULATOR FACILITY ACCESS, MEMBERSHIPS, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." LASERSHOTS, LLC EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Assumption of Risk & Limitation of Liability

Assumption of Risk: Participation in virtual shooting simulators, marksmanship training, and handling inert or recoiling training equipment involves inherent physical activity. You voluntarily assume all risks associated with your participation on our premises, as further detailed in the In-Store Liability Waiver.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, LASERSHOTS, LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF YOUR USE OF OUR PRODUCTS, FACILITY, MEMBERSHIPS, OR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO LASERSHOTS, LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR $100.00, WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless LaserShots, LLC, its members, officers, and employees from any third-party claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising out of your violation of this TOS, your negligence or misconduct at our facility, or your failure to comply with applicable firearm laws.

12. Privacy Policy

Your use of our website, store services, online booking platforms, and digital applications is also governed by our Privacy Policy, located at https://lasershots.com/privacy-policy. The Privacy Policy describes how we collect, use, store, and protect your personal and transactional information. By using our Services, you acknowledge that you have read and agree to the terms set forth in the Privacy Policy, which is hereby incorporated by reference into this TOS.

13. Electronic Communications

By purchasing products, booking simulator time, enrolling in a membership, or providing your contact information, you consent to receive communications from us electronically (via email or SMS). You may opt out of marketing communications at any time.

14. Payment Processing & Saved Methods

By providing payment information for retail purchases, simulator bookings, or memberships, you represent that you are authorized to use the designated payment method and authorize LaserShots, LLC to charge the total agreed amount, including recurring membership fees and any applicable early termination fees set forth in Section 5 or your standalone Membership Agreement.

15. Governing Law & Dispute Resolution

Governing Law: This TOS is governed by the laws of the State of Alabama, without regard to its conflict of law principles.

Mandatory Binding Arbitration: YOU AND LASERSHOTS, LLC AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THIS AGREEMENT, STORE PURCHASES, MEMBERSHIPS, OR FACILITY USE SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING INDIVIDUAL ARBITRATION IN DOTHAN, ALABAMA.

Class Action Waiver: YOU AGREE THAT CLAIMS MAY ONLY BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16. Mobile Messaging Terms & Conditions

  • Consent: By providing your mobile phone number and opting in, you consent to receive recurring automated promotiaonal and personalized marketing or transactional text messages (e.g., booking confirmations, sales alerts, card reminders) from LaserShots, LLC. Consent is not a condition of purchase.

  • Opt-Out: Text STOP to cancel at any time. Text HELP for for assistance.

  • Rates: Mesages and data rates may apply. Message frequency varies.

  • Mobile Privacy Safeguard: Mobile information will not be shared with third parties or affiliates for marketing/promotional purposes. This excludes text messaging originator opt-in data and consent; this information will not be shared or sold to any third parties.

17. Severability & Entire Agreement

If any provision of this TOS is deemed unenforceable, the remaining provisions shall remain in full force and effect. This TOS, together with the Privacy Policy located at https://lasershots.com/privacy-policy, our Shipping Policy, our Return & Cancellation Policy, any executed In-Store Liability Waiver, and any standalone Membership Agreement, constitutes the complete agreement between you and LaserShots, LLC regarding store purchases, memberships, facility use, and related services.
